Welcome to Sarmia. These Terms and Conditions ("Terms") govern your use of Sarmia’s services and website, including the purchase and use of our at-home DNA saliva testing kits and personalised nutrition reports with custom vitamin recommendations. By accessing our website or using our services, you agree to these Terms. If you do not agree, you should not use our website or services. These Terms are written in plain language to help you understand your rights and obligations.

Please read these Terms carefully. They apply to all users of Sarmia’s services in Australia. They also include important disclaimers and information about how we handle your data, your consumer rights, and our partnerships with third-party providers. Nothing in these Terms is intended to limit any rights you have under Australian law.

Scope of Services

Sarmia provides a personalised nutrigenetics service designed to help you learn about your nutritional needs. Our core services include:

  • DNA Testing Kit: We provide an at-home saliva collection kit for you to collect your DNA sample. You will use this kit to safely provide a saliva sample from the comfort of your home.

  • Laboratory Analysis: Your saliva sample is sent to our partner laboratory, the Australian Genome Research Facility (AGRF), for genetic analysis. AGRF is a certified laboratory that will extract and analyse DNA from your sample to identify specific genetic markers related to nutrition and wellness.

  • Health Questionnaire: We may ask you to complete an online health and lifestyle questionnaire. This questionnaire gathers information about your diet, habits, and health goals. The information you provide helps us tailor your report and recommendations more accurately.

  • Personalised Nutrition Report: After analysis, Sarmia will generate a personalised nutrition and wellness report for you. This report includes insights into how your genetics may affect your nutritional needs, and it provides recommendations for diet and lifestyle adjustments. The report will highlight areas such as vitamin and mineral needs based on your genetic makeup and questionnaire responses.

  • Custom Vitamin/Supplement Recommendations: Based on your DNA results and provided information, we will recommend a custom vitamin or supplement regimen tailored to your needs. This may include a list of specific vitamins, minerals, or other nutrients and the recommended dosages for you.

  • Compounded Supplement Service: If you choose, Sarmia can arrange for a personalised supplement to be made for you. We work with our partner compounding pharmacy, ACPHARM (Australian Custom Pharmaceuticals), to create custom vitamin supplements that match the recommendations in your report. These supplements are made to order, using high-quality ingredients, and are tailored specifically for you.

Our service is not a medical or diagnostic service – it is a wellness and informational service. The genetic analysis and recommendations are intended to help you make informed decisions about your nutrition and lifestyle. We do not diagnose diseases or conditions, and our reports are not a substitute for medical advice or medical tests provided by doctors.

Eligibility and User Obligations

By purchasing or using Sarmia’s DNA testing and nutrition services, you confirm that you meet the following criteria and agree to the following responsibilities:

  • Age Requirement: You must be at least 18 years old to purchase our DNA test kit or use our services. Our services are intended for adults. If you are under 18, a parent or legal guardian must purchase the service and provide written consent for your participation. By agreeing to these Terms, you confirm that you are 18 or older, or that you are the parent/guardian of the person being tested and have the authority to consent on their behalf.

  • Personal Use: You agree to use the DNA test kit and our reports for your personal use or for a person for whom you are the legal guardian. You will not use the kit or our services for any unlawful purpose or on behalf of anyone else without proper authority.

  • Accurate Information: You agree to provide accurate, current, and complete information at all stages of our service. This includes your personal details (such as name and date of birth), your contact and shipping information, and any responses you give in the health questionnaire. You understand that the quality and usefulness of your personalised report depend on the accuracy of the information you provide. If you provide false or misleading information, the insights and recommendations in your report may be invalid or inappropriate.

  • DNA Sample Collection: You are responsible for collecting your saliva sample according to the instructions provided with the kit. This means following all the steps (such as fasting or not eating/drinking if instructed, sealing the sample correctly, and mailing it back promptly). Do not send any biological sample other than your own saliva (or that of the person for whom you are the guardian and have consent). By submitting a sample, you represent and warrant that the sample is your own DNA (or that of a person you are legally authorised to represent), and that you have not tampered with the sample.

  • One Kit, One Person: Each test kit is intended to be used by a single individual. Do not use the same kit for multiple people. If you need to have multiple people tested, you must purchase a separate kit for each person.

  • Account Security: If our service requires you to create an online account or register your kit, you are responsible for keeping your login credentials secure. Do not share your username or password with others. You are responsible for all activities that occur under your account. If you suspect any unauthorised access to your account, please notify Sarmia immediately.

  • Compliance with Instructions: You agree to follow all instructions and guidelines we provide for using the kit, completing the questionnaire, taking any recommended supplements, and accessing your report. This includes any safety instructions, such as storage of the kit and proper usage of supplements.

  • Health Precautions: If you decide to implement any dietary changes or begin taking any supplements based on our report, you are responsible for first considering your own health conditions and, if appropriate, consulting with a healthcare professional. (See “Health and Medical Disclaimers” below for more details.) You should especially seek medical advice if you have any pre-existing medical conditions, are pregnant or breastfeeding, or are taking any medications, before making significant changes or starting new supplements.

By fulfilling these responsibilities, you help us ensure that our service works as intended and that you get the most accurate and useful results. Failure to meet these obligations (for example, providing incorrect information or not following the kit instructions) may result in delays, inaccurate results, or an inability for us to complete the service. In such cases, Sarmia is not liable for any outcomes that result from these failures on your part (to the extent permitted by law).

Consent to DNA Testing and Use of Data

By purchasing our service and sending us your DNA sample, you give your consent for the following:

  • DNA Analysis: You explicitly consent to Sarmia and our partner lab (AGRF) performing genetic analysis on the saliva sample you provide. This means you understand that your DNA will be extracted from the sample and examined for specific genetic variants related to nutrition and wellness.

  • Use of Personal Information: You consent to Sarmia collecting and using your personal information and health data (including the information from your questionnaire and your genetic data) for the purpose of providing you with the personalised nutrition report and supplement recommendations. We will handle this information in accordance with our Privacy Policy (see “Privacy and Data Protection” below).

  • Parental Consent for Minors: If you are providing a sample on behalf of someone under 18 (with our prior arrangement), you confirm that you are the parent or legal guardian of that minor and that you have the authority to consent to the DNA testing and data collection for them. You agree that the minor will be bound by these Terms through your acceptance on their behalf.

  • Sample Storage and Disposal: You understand and agree that your biological sample (saliva) will be shipped to the lab and used for DNA analysis. Any remaining sample after testing will not be returned to you. Typically, remaining portions of your sample may be safely stored for a short period or destroyed by the lab according to their standard procedures. By using our service, you consent to this process. If you have concerns about sample retention or destruction, please contact us for more information before submitting your sample.

  • Data Storage: You agree that Sarmia and its partners may securely store your genetic data and personal information as needed to fulfill the service and for legal record-keeping. We will not perform any analysis on your DNA beyond what is needed for the services you have requested, unless you provide additional consent for future services or research (optional and not assumed).

  • Future Communications: You consent to Sarmia contacting you via email, phone, or other contact details you provided, for purposes related to your order and service. This includes communications about kit delivery, sample status, results availability, and customer support. We may also contact you with information about updates to our services or additional offers, but you will have the option to opt-out of marketing communications if you wish.

By giving this consent, you acknowledge that you understand what the DNA test entails and the ways in which your information and sample will be used. If at any point you wish to withdraw your consent, please contact us. Note that if you withdraw consent after submitting your sample, we will stop any further analysis or use of your data to the extent possible, but we may still need to retain certain information as required by law or for our internal compliance records.

Ordering, Pricing, and Payment

When you purchase a Sarmia DNA testing and nutrition service, the following terms apply:

  • Placing an Order: Orders for Sarmia kits and services can be placed through our official website (sarmia.com.au) or through authorised channels specified by Sarmia. To place an order, you may need to create an account or provide necessary personal and payment information. You must ensure all information you provide is accurate (including your delivery address and contact details).

  • Pricing: All prices for our products and services are listed in Australian Dollars (AUD). Prices are inclusive of GST (Goods and Services Tax) where applicable, unless stated otherwise. The total price at checkout will include any applicable taxes and shipping fees (if any). We strive to ensure that pricing information is correct, but if there is an obvious error in pricing, we will contact you and give you the option to reconfirm or cancel your order.

  • Payment: Payment is required at the time you place your order. We accept various payment methods (e.g., credit/debit cards or other payment providers as listed on our site). By providing your payment information, you represent that you are authorised to use the payment method and you authorise us (or our third-party payment processor) to charge the full order amount to that payment method. All transactions are processed through secure encryption to protect your financial data.

  • Order Confirmation: Once your order and payment are received, we will send you an order confirmation via email. This will include your order details and an estimated timeline for shipping your DNA kit. This confirmation signifies that we have accepted your order, at which point a contract is formed between you and Sarmia under these Terms.

  • Delivery Fees: If there are any additional fees for shipping or handling (for example, if you are in a remote area or if you request expedited shipping), these will be clearly communicated to you before you complete your purchase. Most standard kit deliveries within Australia are included or charged at a flat rate, as specified during purchase.

  • International Orders: At this time, Sarmia’s services are primarily offered within Australia. If we offer international shipping of kits or delivery of supplements outside Australia, additional terms (such as different shipping fees, customs duties, or restrictions) may apply. These would be communicated to you in the ordering process. It is your responsibility to ensure that importing a DNA test kit or supplements is legal in your country and to pay any applicable import duties.

  • Promotions and Coupons: From time to time, Sarmia may offer promotional codes, discounts, or special offers. These are subject to any specific terms we publish with them. Promotions are typically limited-time and may have eligibility conditions. Unless stated, promotional discounts apply only to the service price and not to extra fees like shipping. We reserve the right to end or modify promotions at any time. If you have a coupon or code, it must be applied at the time of purchase – we cannot apply discounts retroactively.

Shipping, Delivery, and Sample Return

We aim to deliver your DNA test kit and any personalised supplements to you in a timely and secure manner. Please note the following regarding shipping and delivery:

  • DNA Test Kit Delivery: After your order is confirmed, we will dispatch your saliva collection kit to the shipping address you provided. Kits are usually dispatched within 1-3 business days of order confirmation (Monday to Friday, excluding public holidays). Delivery times can vary depending on your location. Within Australia, please allow approximately 3-7 business days for the kit to arrive after dispatch. We will provide an estimate or tracking information (if available) once your kit is shipped. If you do not receive your kit within a reasonable time frame, please contact us so we can assist.

  • Shipping Method: Kits are sent via reputable postal or courier services. We take care to package the kit securely. However, once dispatched, delivery times are subject to the carrier’s schedules and any unforeseen delays (such as postal delays, public holidays, or extreme weather events). Sarmia is not liable for delays caused by third-party delivery services, but we will help troubleshoot any issues with lost or delayed packages.

  • Receipt of Kit: Upon receiving your kit, please check that it includes all necessary components (collection tube, instructions, packaging to return the sample, etc.). If anything is missing or damaged on arrival, do not use the kit and notify Sarmia immediately so we can send a replacement.

  • Returning Your Sample to the Lab: Each kit includes instructions for how to send your saliva sample back to our partner lab. In most cases, a prepaid return mailer or shipping label is provided for your convenience (within Australia). Follow the included instructions to seal your sample properly and send it back as soon as possible after collection. Delays in returning your sample could affect the viability of the sample or delay your results.

  • Sample Delivery to Lab: Sarmia and AGRF are responsible for receiving your sample once it arrives at the lab. If the sample is lost or damaged in transit on the way back to us, please contact us – we will work with you to resolve the issue (often by sending a new kit at no additional cost).

  • Personalised Supplement Delivery: If you opt to have a personalised supplement formulated through ACPHARM following your report, the supplement will be shipped to you after it has been prepared. Compounding your custom supplement may take some time (typically a few days) after your report is ready, as it is made to order. We will inform you of the expected delivery timeline for the supplement. Generally, supplements are shipped via courier or postal service directly from our pharmacy partner to the address you provided.

  • Shipping Costs for Supplements: If your service package includes the personalised supplement, shipping may be included. If the supplement is an optional add-on or a separate purchase, there might be a shipping fee, which will be communicated to you at the time of arranging the supplement order.

  • Delivery Issues: If you encounter any delivery issues – for example, if the kit or supplement package does not arrive, arrives opened or damaged, or is delivered to the wrong address – please inform us as soon as possible. For lost or severely delayed shipments, we will coordinate with the carrier to locate the package or send you a replacement as needed. For damaged shipments, please take photos of the damage and keep all packaging, then contact us so we can resolve the problem (such as sending a replacement kit or product). We want to ensure you receive what you paid for in good condition.

  • Risk and Title: Ownership of the DNA kit and any physical goods (like supplement bottles) passes to you once they are delivered to your address. However, the DNA sample you send back becomes our responsibility once received by the lab. The risk of loss or damage to the kit in transit is generally borne by us until delivery to you, and by you when you send the sample back until received by us. We recommend sending the sample using the provided materials to ensure safe delivery. If you choose an alternative method to return the sample that we did not provide or recommend, you assume the risk for any loss in transit.

Our goal is to make the shipping and delivery process reliable. However, please understand that sometimes delays or issues can occur. We appreciate your patience and will work with you to sort out any delivery problems. Always feel free to reach out to our support if you have concerns about your shipment.

Provision of Results and Services

Once your sample reaches our lab and your data is analyzed, we will prepare your report and any related services as follows:

  • Analysis Timeframe: On average, from the time the lab (AGRF) receives your saliva sample, it may take a few weeks (typically around 3-6 weeks) to complete the genetic analysis and prepare your personalised report. This timeframe can vary depending on lab workflow and any unforeseen technical issues. We do our best to deliver results promptly, but we cannot guarantee a specific turnaround time. We will keep you updated if there are significant delays.

  • Delivery of the Nutrition Report: When your personalised nutrition report is ready, we will deliver it to you electronically. Usually, this will be through a secure online portal or via email as a PDF document. We will notify you by email when your results are ready, with instructions on how to access them. The report will detail your genetic findings related to nutrition and our recommendations for diet and supplements.

  • Report Contents: Your report will include explanations of what was tested (the genes or biomarkers), what your results mean in terms of nutritional needs or tendencies, and personalised recommendations. We strive to write the report in clear, understandable language. It may also have visual aids like charts for easier interpretation. If you have trouble understanding any part of the report, you can contact us with questions. However, remember that we cannot provide medical advice (see the next section for more on this).

  • No Medical Interpretation Provided by Sarmia: Our team will not provide medical interpretation or diagnosis from your genetic results. If you have questions about how your results relate to medical conditions or medications, you should consult a doctor or a genetic counselor. We provide support to clarify the content of the report, but not medical consultations.

  • Personalised Supplement Recommendation and Formulation: Along with the report, if applicable, we provide a recommendation for a custom supplement formula. If you have elected to receive the personalised supplement, we will forward the formula to ACPHARM for compounding. ACPHARM’s pharmacists will prepare the supplements in the form of capsules or tablets as needed. We will ensure that the compounding is done according to the specifications in your report (e.g. the correct dosages of each vitamin/mineral).

  • Quality of Supplements: The supplements formulated by ACPHARM use high-quality ingredients and are prepared under pharmacy standards. They are made specifically for you, based on your genetic results and needs identified. Please follow the usage instructions that come with your supplement (e.g., dosage per day, with food, etc.). If you have any adverse reaction or issue with the supplement, discontinue use and contact us or a healthcare professional.

  • Follow-Up Support: After you receive your report (and supplement, if ordered), Sarmia may offer a follow-up consultation or support via email or phone to answer any general questions about the report. This is not guaranteed for every purchase, but we aim to help you understand the findings. Any such support does not constitute medical or nutritional counselling beyond explaining our recommendations. We welcome feedback, and if you believe something in your report is inaccurate or unclear, please let us know so we can address it.

  • Updates to Reports: If, in the future, significant new scientific research emerges that changes the interpretation of a result in your report, we may, at our discretion, send you an update or offer an updated analysis (especially if it directly affects a recommendation we gave you). However, we are not obligated to re-analyse past results unless it falls under a service or subscription you have with us. We do continually update our knowledge base for new customers and future reports.

  • Use of Service for Informational Purposes: You agree that you will use the information provided in your report responsibly. It is meant to inform and guide you in general health and wellness decisions, but any major changes should be done carefully and ideally with professional guidance. You are in control of how you implement any recommendations.

We are committed to delivering a high-quality service that meets the scope described. If something goes wrong on our end (for example, a report is not generated properly, or there’s a mistake in your results due to our error), we will address it as part of our Refunds and Guarantee policy described later. Ultimately, we want you to have a positive experience and gain useful insights from Sarmia’s service.

Health and Medical Disclaimers

Sarmia’s services focus on nutritional and wellness insights derived from your DNA and self-reported information. It is important to understand the following disclaimers about the nature of our service:

  • Not Medical Advice: The information and recommendations provided by Sarmia (whether in your personalised report, on our website, or via any communication) are for informational and educational purposes only. While our goal is to help you make informed decisions about nutrition and lifestyle, we are not providing medical advice. Our service is not a substitute for professional medical advice, diagnosis, or treatment. You should not ignore or delay seeking medical advice because of information from our service.

  • No Doctor-Patient Relationship: Using Sarmia’s service does not create a doctor-patient (or dietitian-patient) relationship between you and Sarmia. We are not a healthcare provider. We strongly encourage you to consult with qualified health professionals (such as your GP, a dietitian, or a genetic counselor) about your results, especially before making any significant changes to your diet, exercise, or supplement routine.

  • For Wellness Use Only: Our DNA test and report are designed to offer insights into nutrition and wellness traits (for example, how you might metabolise certain nutrients or tendencies for certain dietary needs). The report is not intended to diagnose, predict, or screen for any diseases or medical conditions. It also does not test for all possible genetic variants related to health. You should not use our service to make decisions about medical treatment or to replace medical tests recommended by a doctor.

  • Individual Results May Vary: Genetics is only one factor in your health and nutrition. The recommendations we provide are based on population research and may not account for every aspect of your personal situation. Two individuals with similar genetic results might still have different ideal diets because of other factors like environment, health conditions, or preferences. We do not guarantee that following our recommendations will lead to health improvements or specific results. For example, if we suggest a higher intake of a certain vitamin and you follow that advice, you may or may not feel a noticeable difference – many factors influence health outcomes.

  • Supplements and Allergies: If you choose to take any vitamins or supplements recommended by Sarmia, you do so voluntarily. While we strive to recommend generally safe, high-quality supplements, any supplement can carry risks including allergic reactions or interactions with other medications you may be taking. Always check the ingredient list of any supplement we provide or recommend. If you have known allergies or intolerances, inform us before the supplement is compounded, and double-check ingredients upon receipt. If you experience any adverse effect (e.g. nausea, headache, rash, etc.), stop taking the supplement and consult a healthcare professional if necessary.

  • Consult Before Major Changes: Always consider seeking advice from a healthcare provider before making significant lifestyle changes based on our report. This is especially important if our recommendations include things like cutting out major food groups (e.g., going gluten-free or dairy-free) or taking high doses of a nutrient.   • No Guaranteed Outcomes: Sarmia does not guarantee any specific outcome from using our services.   • Reliance on Information: Any reliance you place on the information from Sarmia is at your own risk. We aim to be accurate and up-to-date, but we make no warranties that every piece of information is error-free or comprehensive. We are not responsible if you interpret or apply the information in ways that cause you harm. For example, if you misread the report and take an incorrect dosage of a supplement, we cannot be held liable for the consequences — so please read carefully and ask questions if anything is unclear.

In summary, use our service as a helpful guide, not the final authority on your health. We encourage an informed and cautious approach: use our insights as one input among many, combined with professional advice and your own judgment. Always prioritize your health and safety by involving qualified medical professionals in any significant health decisions.

Scientific Limitations and Evolving Knowledge

Genetic science and nutrition science are continually advancing fields. It’s important to understand the limitations of our testing and recommendations:

  • Scope of Genetic Analysis: The DNA analysis performed by our partner lab (AGRF) focuses on specific genes and genetic variations (often called SNPs – single nucleotide polymorphisms) that research has found to be related to nutrition and metabolism. Our test does not sequence your entire genome. We only look at particular genetic markers that are relevant to our report. There may be other genes or factors not included in our test that influence your nutrition needs.

  • Current Scientific Research: The insights and recommendations we provide are based on the current body of scientific evidence and research available. We use reputable studies, clinical research, and expert knowledge to interpret your genetic results. However, science can change. New research might emerge that enhances or even contradicts current understanding. Sarmia commits to staying up-to-date with scientific developments and adjusting our reports for new customers accordingly. However, your specific report is based on knowledge available at the time of its creation.

  • Accuracy of the Lab Testing: Our partner lab uses high-quality, accredited methods to analyse your DNA. The accuracy of genotyping for each genetic marker is very high (typically well above 99%). However, no laboratory test is 100% free of error. There is a very small chance that:

    • The lab may not be able to process your sample (for example, if not enough DNA was collected or the sample was contaminated).

    • There could be a technical error in reading a particular genetic marker.

    • In rare cases, unexpected laboratory issues (equipment failure, human error) could affect results. In such cases, we may need to obtain a new sample from you or re-run the test. We will communicate with you if we encounter any issues and will typically offer a replacement kit and re-testing at no additional charge if needed.

  • Interpretation of Results: We interpret genetic results using statistical associations and population-level data. A genetic variant might increase your need for a certain nutrient on average, but individual experiences vary. Limitations of interpretation include:

    • Environment and Lifestyle: Factors like your diet, exercise, stress, and overall health can influence or override genetic tendencies. Our report does consider some of this through your questionnaire answers, but it cannot capture everything.

    • Polygenic Factors: Many traits are influenced by multiple genes working together, plus environment. We might report on a few key genes, but not all genetic factors are known or included. Thus, our recommendations cover the major genetic factors, not all possible factors.

    • Uncertainty: If the scientific community has not reached a strong consensus on a particular genetic effect, we either will not include it or will mention it with caution. We aim to be transparent about how confident we are in each recommendation (for example, if evidence is preliminary, we will note that).

  • No Diagnostic Testing: Our test is not designed to detect genetic diseases or serious health-related genes (such as those used in medical genetic testing for cancer risk, etc.). We purposely limit our analysis to nutrition and wellness-related genes to avoid encroaching on medical testing territory. Therefore, absence of any warning in our report is not a clean bill of health. You might have other genetic predispositions (unrelated to nutrition) that our test does not cover at all.

  • Updates and Changes: Because the field is evolving, Sarmia may update the content or format of its reports over time. If you purchase a service at one point in time, that report reflects the science then. We do not automatically update old reports when science changes, but we may inform you of major changes if they are highly relevant. For example, if a critical error in interpretation was discovered after your report, we would correct it and send you an update.

  • User Understanding: We make every effort to explain the scientific concepts in your report plainly. However, some concepts may still be complex. We provide glossaries or additional resources for understanding genetic and nutritional terms. If you find any part confusing, you can reach out for clarification. Keep in mind that misunderstanding the science could lead to misapplication of advice, so use the resources provided to fully understand your report.

In essence, while we leverage the best science available to deliver your results, the service has inherent limitations. We want you to be aware of these so you can appreciate what the results do and do not mean. We encourage a mindset of using this information as one piece of your health puzzle, open to future updates and in conjunction with other health information.

Privacy and Data Protection

Your privacy is extremely important to us. We handle your personal information, including sensitive health and genetic data, in accordance with applicable Australian privacy laws and our own strict policies. Below is an overview of our privacy practices related to the Sarmia service:

  • Collection of Personal Information: During the process of using our service, we collect personal information such as your name, contact details (address, email, phone number), date of birth, and payment information. We also collect health-related information through your questionnaire responses and, of course, genetic information from your DNA sample.

  • Use of Information: We use your information solely for purposes of providing and improving our services. This includes processing your order, delivering your kit, performing the DNA analysis (through AGRF), generating your report, formulating your supplement (through ACPHARM), and communicating with you about your results or customer support issues. We may also use your information to send service-related updates or offers, but you can opt out of marketing communications at any time.

We will not share your identifiable genetic or health data with any third parties except as necessary to provide the service (for example, we share your sample and a reference code with AGRF for testing, and relevant recommendations or formula details with ACPHARM for compounding your supplement). These partners are bound to confidentiality and to use the data only for the specific purpose we request.

  • Third-Party Privacy: AGRF and ACPHARM, as our service partners, have their own privacy and data handling standards. We have agreements with them to protect your data. For instance, the lab results are typically reported back to us using only your first name or an ID; and the pharmacy receives only the information needed to make and send your supplement (such as your first name, the formula, and shipping address). They do not get full access to your entire genetic report or unrelated personal data.

  • Data Security: We employ industry-standard security measures to protect your personal and genetic information. This includes encryption of data in transit (for example, when you enter information on our website or when we transmit data to the lab) and encryption of sensitive data at rest. Our databases and servers are secured against unauthorised access, and we limit internal access to personal data strictly to personnel and partners who need it to perform their duties.

  • Data Storage Duration: We will retain your personal information and genetic data only for as long as necessary to fulfill the purposes of the service and as required by law. Genetic test results and reports may be stored so that you can access them in the future and so that we have them for reference if you use our service again or need support. If you wish to have your personal data or results deleted after the service is completed, you may contact us with such a request. We will inform you what data can be deleted and if any data must be retained to comply with legal obligations (for example, transaction records for accounting or any health records we’re required to keep).

  • De-identified Data Usage: Sarmia may use de-identified or aggregated data (information that has had personal identifiers like your name and contact removed) for purposes such as research and improving our services. For example, we might analyze trends across many customers’ results to refine our recommendations or to publish insights about nutrigenetics. Such analysis will not identify you personally, and we do not share individual-level data publicly. We do not sell your personal data to any third-party marketers or external researchers without your explicit consent.

  • Privacy Policy: We have a detailed Privacy Policy document that provides more information on how we handle your data, your rights to access or correct your data, and how to contact us about privacy concerns. By agreeing to these Terms, you also acknowledge that you have read or have access to Sarmia’s Privacy Policy. If there is any discrepancy between this summary and the full Privacy Policy, the Privacy Policy will govern.

  • Consent for Data Use: By using Sarmia’s services, you consent to the collection, processing, and use of your personal information (including sensitive health and genetic information) as described in these Terms and in our Privacy Policy. We will not use your data for any purpose contrary to what we have stated. If we ever seek to use your data in a new way (for example, if we start a research project that would involve your identifiable data), we will seek your additional consent.

  • Data Breach Protocol: In the unlikely event of a data breach or any unauthorized access to your personal information, we have a response plan in place (as required by Australian law). We will notify affected individuals and the appropriate authorities (like the Office of the Australian Information Commissioner) as required, and we will take steps to mitigate any harm and prevent future incidents.

Your trust is essential to us. We understand the sensitive nature of genetic and health information and are committed to protecting your privacy every step of the way. Third-Party Service Providers and Partners

In delivering our service to you, Sarmia works closely with two key third-party partners: a genetic testing laboratory and a compounding pharmacy. We want to clarify how these partnerships work and our respective responsibilities:

  • Laboratory – Australian Genome Research Facility (AGRF): AGRF is an external laboratory that specializes in genetic testing. When you send in your saliva sample, Sarmia forwards it to AGRF for processing. AGRF scientists and technicians extract DNA from your sample and perform the genetic tests that Sarmia has selected (the specific genetic markers related to nutrition). AGRF then provides the results of those tests back to Sarmia (usually in a secure data format).

    • AGRF’s Role: AGRF is responsible for handling your sample professionally and maintaining quality control during the DNA analysis. They adhere to scientific and ethical standards and are experienced in genomic services. AGRF is NATA accredited (National Association of Testing Authorities, Australia) for laboratory testing, which means their processes meet high standards of accuracy and reliability.

    • Data Privacy: AGRF receives your sample labeled with a unique identifier (and possibly your first name or a code), rather than all your personal details. This is to protect your privacy. They do not receive things like your full questionnaire answers or payment information – only what’s needed to do the test. AGRF will not use your DNA sample or data for any purpose other than the test Sarmia requested, and they will dispose of the sample after testing in accordance with their protocols.

    • Limit of AGRF’s Liability: While AGRF performs the lab work, your contract remains with Sarmia. If there is a lab error or issue, Sarmia will work with AGRF to rectify it (for example, re-testing your sample or providing a replacement kit). You agree that AGRF, as an independent service provider, does not have a direct contractual obligation to you under these Terms (you would not typically sue AGRF for an error; any issues would be handled by Sarmia as part of our service obligations to you). Sarmia, in turn, may have recourse with AGRF.

  • Compounding Pharmacy – ACPHARM (Australian Custom Pharmaceuticals): ACPHARM is a licensed compounding pharmacy that works with Sarmia to create the custom vitamin supplements recommended in your report. If your service package includes a personalised supplement, or if you order a custom supplement after receiving your report, Sarmia will transmit the necessary formulation information to ACPHARM.

    • ACPHARM’s Role: ACPHARM pharmacists will take the ingredient list and dosages recommended by Sarmia for you and compound them into a supplement (often capsules). They are responsible for sourcing the ingredients, measuring and mixing them accurately, and producing the final supplement product safely. They will then package and ship the supplement to you on Sarmia’s behalf.

    • Quality and Safety: ACPHARM, as Australia’s largest compounding pharmacy, follows strict regulations and standards for pharmaceutical compounding. The supplements they produce for Sarmia customers are made under controlled conditions. They use pharmaceutical or high-grade ingredients. However, because these supplements are personalised, they are not “off-the-shelf” products – they are made specifically for you and not evaluated by the Therapeutic Goods Administration (TGA) as a unique product (since compounding is regulated differently from mass-produced supplements). You acknowledge this difference. Sarmia chooses to partner with ACPHARM due to their excellent reputation and quality focus.

    • Data Sharing: We share with ACPHARM only the information required to fulfill your supplement order. This generally includes your first name (for labeling), your age or gender if relevant for dosing, the specific formula (which vitamins and how much of each), any noted allergies (to avoid certain ingredients), and your delivery address. ACPHARM does not receive your full genetic report or unrelated personal data. They treat all information as confidential medical data.

    • Limit of ACPHARM’s Liability: Similar to AGRF, ACPHARM is an independent contractor. If there were an issue with the supplement (for example, a mistake in formulation or a quality problem), Sarmia will coordinate to fix it (such as having ACPHARM remake the supplement or issuing a refund). By accepting these Terms, you agree that any legal claims regarding the supplement will generally be directed to Sarmia as the provider of the service to you, not directly to ACPHARM. Of course, Sarmia in turn ensures ACPHARM upholds their obligations.

  • Other Third Parties: Aside from AGRF and ACPHARM, Sarmia may use other third-party services to support our business (for example, payment processors, IT cloud services, shipping carriers, etc.). These providers might handle your data or the logistics of the service in limited ways. We select reputable providers and have agreements in place to safeguard your information. None of these third parties are allowed to use your information for anything other than the specific service they provide to us.

  • No Endorsement of Unrelated Third Parties: Our website or reports might sometimes mention third-party products or services (for example, if we suggest you could benefit from a general supplement available on the market, or provide a link to a recipe or product). Any such mention is for informational purposes; it is not an endorsement or guarantee by Sarmia of those third-party products. We do not take responsibility for products or services we don’t directly provide. Always use your discretion and check third-party terms when engaging with anything outside of Sarmia’s provided service.

By understanding the role of these partners, you can have confidence in how our service is delivered. We believe in transparency: we want you to know who is handling your sample and who is making your supplement. Our partnerships are there to ensure you get the best possible quality at each step, and we take responsibility for managing those partners to meet our high standards and your expectations.

Intellectual Property

All content and materials provided by Sarmia in the course of delivering our services or on our website are protected by intellectual property laws. Here’s what you need to know:

  • Sarmia Content: The content of your personalised nutrition report, the design and text of our website, our logos, graphics, and any materials included with your kit (such as instruction booklets or brochures) are the intellectual property of Sarmia or its licensors. This includes copyrights, trademarks, and any proprietary information or software used to generate your report.

  • License for Personal Use: When you purchase our service, Sarmia grants you a limited, non-exclusive, non-transferable license to use the materials we provide for your personal, non-commercial use. This means you are free to view your report, print it for your records, and even show it to your healthcare providers or family members. However, you are not authorised to reproduce, distribute, publish, or sell any Sarmia content to others.

  • Prohibited Uses: You agree not to do the following with Sarmia’s intellectual property:

    • You will not copy or share the content of our reports or website for commercial purposes or in a manner not permitted by us.

    • You will not modify or create derivative works of our report content for distribution.

    • You will not use Sarmia’s name, logo, or trademarks without our prior written permission, except as necessary to identify our services (for instance, you can say “I used Sarmia’s service” but you cannot brand a product with our name).

    • You will not reverse-engineer or attempt to extract the source code or algorithms behind any of our services (for example, the logic of how we generate recommendations), as these are proprietary to Sarmia.

  • Your Provided Content: Any information you submit to Sarmia, such as your questionnaire answers or feedback, remains your own property. By providing it to us, you grant Sarmia a license to use that information for the purpose of delivering the service to you (as explained in the Privacy section). We do not claim ownership of your personal data. However, we do own the aggregated results of our analysis (e.g., the compiled data in your report is our work product).

  • DNA Sample: Your DNA sample is your biological property. By sending it to us, you agree that Sarmia and AGRF will consume the sample (extracting DNA, which typically uses most of the saliva sample). The remnants of the sample post-extraction are generally destroyed. You do not have a right to get your physical sample back once submitted, because it will be used up or disposed of during analysis.

  • Feedback and Suggestions: If you provide Sarmia with any suggestions, ideas, or feedback on our services or potential new features, you acknowledge that this feedback is given voluntarily. We are free to use, disclose, or implement such feedback without any obligation to compensate you. This helps us improve our services. We appreciate feedback, but please understand we may or may not act on it.

  • Third-Party IP: If we include any third-party content in our materials (for example, a scientific chart or a recipe from a partner), we will do so with permission and will respect those third-party rights. Similarly, you should not use third-party content through our service in a way that infringes their rights.

  • Consequences of IP Misuse: Unauthorised use of Sarmia’s intellectual property may result in termination of your access to the service and potential legal action. We protect our content to ensure we can continue providing a high-quality service.

In short, we encourage you to use and enjoy the information we provide for your personal benefit. Just remember that the creation of that information and material is Sarmia’s invested effort and property. Respecting these boundaries allows us to continue offering innovative and personalised services to all our customers.

Returns, Refunds and Your Australian Consumer Law Rights

Sarmia is committed to customer satisfaction and to complying with the Australian Consumer Law (ACL). Under the ACL, you have certain rights (called consumer guarantees) that cannot be excluded, and we fully honour those. This section explains our policy on returns and refunds, as well as your legal rights:

  • Consumer Guarantees: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For example, we guarantee that:

    • Your DNA test kit will be of acceptable quality (not defective or damaged) and fit for the purpose of collecting a sample.

    • Our services will be carried out with due care and skill, and within a reasonable time.

    • The personalised supplement (if provided) will be of acceptable quality and match the description we gave you (i.e., it will contain the ingredients and dosages recommended). If we fail to meet any of these guarantees, you are entitled to a remedy. The remedy could be a repair, replacement, or refund, depending on the circumstances, and whether the failure is major or minor under the law.

  • Change of Mind: Please choose carefully, as we are not required by law to provide a refund or replacement if you simply change your mind about wanting the service. Once the kit has been used (or once the lab analysis has started), the service is in progress and involves costs that we cannot recover. However, if you contact us before your kit has been shipped, or very soon after purchase, we may, at our discretion, accommodate a cancellation and refund. This is evaluated case by case and is a gesture of goodwill rather than a legal obligation. If you have any hesitation or questions before ordering, please contact us so we can assist.

  • Faulty or Damaged Kit: If the DNA collection kit you receive is faulty, damaged, or missing components (for example, a tube is cracked, or the seal was broken during shipping), please inform us immediately. We will send you a replacement kit at no additional charge. We may ask for details or a photo of the issue for our records. You will not need to return the faulty kit; you can dispose of it safely after notifying us (unless we specifically request it back for investigation).

  • Sample Processing Issues: If your sample cannot be processed by the lab due to no fault of your own (sometimes a sample may fail quality checks, or the DNA extraction yields insufficient data), we will provide a solution:

    • Re-collection: In most cases, we will send you a new kit and ask you to provide a second sample, free of charge.

    • Refund: If, after a second attempt, we are still unable to get results from your sample, or if there is an issue on our side that prevents us from delivering your report, you may choose to either try again (if feasible) or receive a refund for the service that could not be completed. We will work with you to reach a satisfactory resolution.

  • Delay in Service: If there is an unreasonable delay in delivering your results (far beyond the typical timeframe) that is due to a failing on our part (for instance, we misplaced your sample or there was a significant oversight), you may have the right to cancel the service and request a refund. We ask for your patience for normal delays, but we also commit to transparency. We will keep you informed of any issues. If a delay is so long that the service is essentially not provided within a reasonable time, ACL may consider that a major failure, and you would be entitled to a remedy.

  • Issues with Personalised Supplements: If you receive a personalised supplement that:

    • Was incorrectly formulated (does not match what was described in your report or order),

    • Arrived in damaged or contaminated condition,

    • Is past its use-by date (should not happen with custom fresh compounding, but included for completeness), then please contact us immediately. Do not use any supplement you believe to be incorrect or unsafe. We will arrange for a replacement to be made and sent to you as soon as possible at no cost. In some cases, we may offer a refund instead (for example, if you no longer want the supplement).

  • Returning Products: In general, due to the nature of our service:

    • Used DNA kits (with your sample) cannot be returned to you, and new kits that have been opened are not reusable by anyone else due to hygiene reasons.

    • Personalised supplements are made only for you and cannot be resold or used for someone else. Therefore, returns are typically not accepted unless there was something wrong with the product. If we ask you to return any item (perhaps for investigation), we will provide instructions and cover any shipping costs for the return.

  • Refund Process: If a refund is warranted, we will process it via the original payment method where possible. If you paid by credit card, the refund will go back to that card; if by bank transfer, we will arrange a transfer back, etc. Refunds will be processed promptly once agreed. Please note that bank processing times might cause a few extra days before the money appears in your account.

  • Partial Refunds: If you purchased a bundle (e.g., kit + supplement package) and one part of the service fails, we will fairly calculate a partial refund. For example, if the DNA analysis was done but the supplement could not be delivered and you paid upfront for both, we might refund the portion of the fee attributable to the supplement.

  • No Resale by Customers: Our products (kit and supplements) are intended for the original purchaser’s use only. You are not entitled to resell an unused kit to a third party as a “new” product; doing so may affect warranties and our ability to support the new user (since we won’t have their info on file). If someone else wants to use Sarmia, they should order through our official channels to ensure they get full support and valid Terms applying to them.

  • Third-Party Purchases: If you bought a Sarmia kit or service through an authorised reseller or partner (for example, a pharmacy or a healthcare provider that stocks our kits), the initial purchase contract might be with that seller. In such cases, the seller’s return policy may also apply. You can still come to Sarmia for the service portion (the testing and report), but if you need a refund or return for the kit itself, you might need to go through the original place of purchase. That said, we will always try to assist or direct you appropriately.

  • Shipping Costs: If a return or re-shipment is due to our fault (faulty product, mistake, etc.), Sarmia will cover the shipping costs. If you return a kit or item to us without an approved reason or due to change of mind (which should be within any courtesy period we allow), we may not cover those shipping costs. Generally, we do not refund any express shipping fees or extra services you may have paid for if the base product/service is delivered correctly (for instance, if you paid for expedited shipping and the product arrives in good condition, we won’t refund the shipping if you simply decide you didn’t want the product anymore).

Your Statutory Rights: Importantly, nothing in these Terms is intended to exclude, restrict, or modify your rights under the Australian Consumer Law. In the event of any inconsistency between these Terms and the ACL, the ACL will prevail. You have the right to seek a remedy under the ACL even if we have our own policies, and those rights exist in addition to our policies.

Limitation of Liability

While we strive to provide excellent services, it’s important to understand how we limit our liability to you in connection with your use of Sarmia’s services, to the extent allowed by law:

  • Service Provided “As Is”: Except for the guarantees and responsibilities outlined explicitly in these Terms (and those required by law), Sarmia’s services are provided “as is” and “as available.” This means that, aside from what we promise in these Terms, we do not make any further warranties or guarantees about the service. For example, we do not guarantee that the service will always be uninterrupted or error-free, or that every single insight will be life-changing or completely accurate for every individual. We do commit to due care and skill, but we cannot promise perfection or specific outcomes.

  • No Indirect or Consequential Liability: To the fullest extent permitted by law, Sarmia and its officers, employees, agents, and partners will not be liable for any indirect, incidental, special, or consequential damages that result from your use of (or inability to use) our service or from your reliance on any information provided by us. This includes, for example, any loss of opportunity, loss of income, loss of data, or other intangible losses.

    • For instance, if you rely on something in our report and invest in expensive supplements or a new diet and you feel it didn’t benefit you as expected, you cannot claim those costs or perceived losses back from us. Or if you had a reaction to a supplement because you didn’t heed a warning, we are not liable for those health consequences (assuming we met our duty to inform you properly).

  • Direct Damages Cap: To the fullest extent permitted by law, if Sarmia is found to be liable to you for any reason (whether in contract, tort, or otherwise), our liability will be limited, at our choice, to either:

    1. The resupply of the service (for example, we might offer to do a re-test or provide a corrected report at no charge), or

    2. The cost of having the service supplied again (which in practical terms means a refund of what you paid for the service in question).

    We choose this limitation as it is a standard approach under Australian Consumer Law for services that are not of a kind ordinarily acquired for personal use that exceed a certain value. However, given our service is a personal use service, the main point is: we will not pay more in damages than the amount you paid us for the service.

  • Personal Injury or Death: We do not exclude liability for personal injury or death caused by our negligence or willful misconduct, or for any other liability that cannot be excluded under Australian law. For example, if we did something recklessly that caused you direct physical harm, we know the law would not allow us to just disclaim that. But it’s very hard to imagine such a scenario with our type of service (this is a standard clause to acknowledge the law). We emphasise that our supplements are made to high safety standards, and using them as directed should not cause harm in a normal scenario.

  • Third-Party Acts: We are not liable for the actions or omissions of third parties that are beyond our control. This includes delivery services (for example, if a courier loses your package and that causes you some loss, we’ll help resolve by sending a new kit, but we aren’t liable for any knock-on effects of that delay). It also includes if, for instance, AGRF or ACPHARM had an unforeseeable issue (like a lab machine breakdown or an ingredient supply problem) that delays or impacts your service. We will, of course, use our best efforts to fix any issues that affect you (and provide remedies as per these Terms), but those instances aren’t considered Sarmia breaching the Terms – they are external events we try to manage.

  • User’s Responsibility: You assume responsibility for any results you obtain by using the service and any decisions you make based on those results. Sarmia cannot be held liable for outcomes that result from how you implement the information we provide. For example, if you decide to drastically change your diet in a way that negatively affects you, or you megadose a vitamin beyond our recommendation, that’s within your control, not ours. Similarly, if you share your results with someone else and they make decisions or cause issues, we aren’t liable to third parties who read your report.

  • Force Majeure: Sarmia will not be liable for any failure or delay in performing our obligations if that failure or delay is due to circumstances beyond our reasonable control. This could include events such as natural disasters, acts of war, pandemics, strikes, internet outages, or government restrictions. If such events occur, we will attempt to notify you and will fulfill our obligations as soon as reasonably possible.

  • Aggregate Liability: If for any reason multiple claims arise or there are multiple issues, and even if each issue could theoretically have separate damages, we will still only compensate up to the total amount you paid us. This prevents stacking of claims beyond the service’s value. Again, this is in alignment with us either redoing the service or refunding it as the remedy.

  • No Liability for Incompatible Systems: If our online platform is used to deliver results, note that we aren’t liable for any technical incompatibilities (for example, if your computer or phone is not compatible with our report format, or you have trouble accessing our website due to your device’s constraints). We’ll assist in providing alternate access (like sending a PDF via email if the portal doesn’t work for you), but these are not considered our liability issues.

Always remember, your statutory rights are not limited by this section. This means if our service has a major failure under the ACL, you can seek remedies beyond what’s written here. The intent of this section is to clarify that, aside from those rights and the commitments we explicitly make, we aren’t assuming liability for all possible negative scenarios, especially those out of our control or not caused by any wrongdoing on our part.

Changes to Terms and Service

From time to time, Sarmia may need to update or modify these Terms or the features of our service. Here’s how that works:

  • Updates to Terms: We reserve the right to change these Terms and Conditions when necessary (for example, if laws change, or if we introduce new services or policies). If we make significant changes, we will notify users by posting the updated Terms on our website and updating the “Last Updated” date at the bottom of this document. For major changes that affect existing customers, we may also send an email notification or notify you via your account.

  • Your Acceptance of Changes: Continued use of our services or website after updated Terms are posted will constitute your acceptance of the new Terms. If you do not agree with any changes, you should discontinue use of our services and contact us regarding any concerns. For any order that is in progress (for example, you’ve sent in a sample and are waiting for results), the Terms that were in effect at the time of your order will generally apply to that transaction, unless the change was required by law or you agree to the new Terms.

  • Changes to Services: Sarmia is constantly improving and evolving its service offerings. We may add new features, change existing features, or discontinue parts of the service. For example, we might support a new type of report, update the panel of genes we test, or change how we deliver supplements. We also might decide to stop offering a certain product or feature that is outdated.

    • If a change to the service is expected to materially affect a service you have already paid for, we will inform you. For instance, if we stopped working with a partner lab and had to use a different lab which changes the process, or if we discontinue the supplement service after you’ve ordered it, we will let you know and ensure your order is fulfilled appropriately or offer alternatives/refunds.

    • Most changes will be aimed at enhancing your experience. If we upgrade our website or report format, we don’t necessarily notify all past users unless it impacts them; we just implement it for new cycles.

  • Errors and Omissions: We strive for accuracy in all descriptions and Terms, but if there is an obvious error (like a typo that significantly alters meaning, or an incorrect statement of policy), we reserve the right to correct it. We will clarify to you if something was a mistake. Likewise, if we discover an error in how the service was described to you pre-purchase, we’ll correct it and give you the chance to cancel for a full refund if the corrected description is not satisfactory to you.

  • Transfer or Assignment: Sarmia may transfer or assign its rights and obligations under these Terms to another company in the event of, for example, a merger, acquisition, or restructuring of our business. If that happens, we will ensure that the new entity honours the commitments we’ve made in these Terms. We will notify you if such a transfer occurs. You will not transfer your rights or obligations under these Terms to anyone else without our written consent — these services are personal to you.

Our commitment is to transparency and fairness. We don’t change terms arbitrarily, and we want you to have confidence in the stability of our service. Any changes are usually geared towards compliance or improvement of the customer experience.

Governing Law and Dispute Resolution

This section explains which laws govern these Terms and how disputes will be handled:

  • Governing Law: These Terms and Conditions, and any agreement formed under them, are governed by the laws of Queensland, Australia, as well as applicable federal laws of Australia. This means that the interpretation and enforcement of the contract are subject to Australian law, and specifically the state laws of Queensland (for example, Queensland’s fair trading laws in addition to the ACL).

  • Jurisdiction: If a dispute arises between you and Sarmia that leads to formal legal proceedings, both you and Sarmia agree to submit to the non-exclusive jurisdiction of the courts of Queensland. “Non-exclusive jurisdiction” means that principally, any court in Queensland (state or federal) is a proper venue for resolving disputes, but it does not prevent either of us from seeking to resolve in another jurisdiction if applicable law permits it (however, ordinarily Queensland will be the appropriate forum). In practice, this clause is here to ensure we both acknowledge where legal issues will be handled – which is in Sarmia’s home state.

  • Dispute Resolution and Communication: We genuinely hope to never have serious disputes with our customers. If you have any grievance or something you’re unhappy about, we strongly encourage you to contact us first to discuss or lodge a complaint. Often, disputes can be resolved through communication and we will do our best to address your concerns promptly and fairly.   • Alternative Dispute Resolution: If a dispute can’t be resolved through ordinary customer service communication, we may propose mediation or another form of alternative dispute resolution (ADR) as a less formal, mutually agreeable way to resolve the issue before resorting to courts. ADR is voluntary unless required by law, but it can save time and expense. Both parties would need to agree on this approach.

  • Legal Fees: In any litigation or court proceeding between Sarmia and you, each party will generally bear its own legal costs, except where laws or a court order provides otherwise. Under Australian law, often the losing party might be ordered to pay the winning party’s reasonable costs, but that is at the court’s discretion.

  • Limitation Period: Under Australian law, there are statutes of limitations for when you can bring a claim. We’re not setting a special limitation period here (it will be whatever Queensland law says, typically 6 years for contract claims). But it’s wise not to delay too long if you feel you have a serious issue.

  • International Use: We reiterate that our service is designed for use in Australia. If you access or use the service from outside Australia, be aware that you are still governed by these Terms (and Australian law to the extent of the contract), and we make no guarantee the service is compliant with laws outside Australia. You are responsible for compliance with any local laws if they apply.

Ultimately, we aim to handle any issues in a reasonable, amicable manner. Taking legal action is a last resort for both you and us. This section just clarifies the framework if it gets to that stage.
